Employer Reporting Requirement (EEO-1)
The Equal Employment Opportunity Commission (EEOC) enforces federal laws that prohibit discrimination against job applicants or employees based on race, color, religion, sex (including pregnancy, gender identity, and sexual orientation), national origin, age (40 or older), disability, or genetic information.
As required by the EEOC, all private employers with 100 or more employees must complete an annual EEO-1 report. To support this, covered employers must invite employees to voluntarily self-identify their gender and race.

If you choose not to self-identify, the federal government requires that the company determine this information through visual observation and/or other available data.
